GENERAL TERMS AND CONDITIONS (GTC)

1. subject matter & conclusion of contract

(1) The subject of these GTC is the provision of training by Teamflow GmbH.

(2) Registration takes place via www.teamflow.de or our service provider (e.g. eventbrite, ti.to) and is also valid without a signature. Alternatively, you can register by email or post, but there is no guarantee that places will still be available. You will receive confirmation of your registration by email.

(3) The number of participants is limited for various reasons (spatial, didactic, etc.). Places will be allocated on receipt of registration.

 

2. withdrawal & cancellation

(1) Refunds are excluded, even in the event of non-attendance or termination of the training. However, the participant may appoint a substitute participant if he/she is unable to attend.

(2) Training courses booked by you are guaranteed to take place, i.e. they will not be canceled due to insufficient numbers of participants. Exceptions to this are force majeure and the absence of the trainer due to illness, for example. In this case, we will try to find an alternative date as soon as possible. When making travel bookings, please try to keep them flexible, as we will not accept any costs incurred if the training is canceled or any further recourse claims.

(3) There is no entitlement to a specific trainer and we reserve the right to change the training location within a city.

 

3. participation fees / terms of payment

(1) Fees for participation in training courses are due seven days before the start of the course. Participation in training is not possible without payment.

(2) You will receive a written invoice for the participation fee.

(3) Drinks during breaks and lunch are included in the participation fees for training courses open to the public. Travel, accommodation and meals outside the training course are the responsibility of the participant.

 

4. certification & data transmission

(1) Registration, administration and processing of the training courses are handled via an automated IT system.

(2) The implementation of the training requires that the participant's data is transmitted to the owner of the training system (e.g. Scrum Inc., Scrum Alliance, Kanban University, etc.) and is then publicly visible. If no certification is desired, this must be communicated before the end of the training at info@teamflow.de.

(3) Participants can revoke their consent to the use of their data at any time with effect for the future by post or email to info@teamflow.de.

(4) Attendance for the entire duration of the course is a prerequisite for certification.

 

5. liability

(1) Teamflow shall be liable for damages to life, body and health, which are attributable to a negligent or intentional breach of duty on our part or on the part of our vicarious agents, in accordance with the statutory provisions.

(2) Damages that are not covered by sentence 1, but are nevertheless based on intentional, fraudulent or grossly negligent breaches of contract on the part of Teamflow or its vicarious agents, shall also be liable in accordance with statutory provisions. In the case of non-intentional behavior, however, these are limited to the foreseeable, usually occurring damage.

(3) Participants are responsible for any items they bring with them and must remove them at the end of the course.

(4) Participants are liable for damage and loss to the training room and its inventory caused by them.

(5) Participants must behave during and before/after training in such a way that other participants or residents are neither harmed nor have reason to complain.

 

6. other

(1) The contractual relationship is subject to German law. The place of performance for all claims arising from the contract shall be the venue of the event. The place of jurisdiction for disputes is - as far as permissible - Berlin.

(2) Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, this shall not affect the validity of the remainder of the contract.

(3) Amendments or supplements shall only be effective if confirmed in writing by Teamflow.

(4) Any training material issued is protected by copyright and may not be used without the written permission of Teamflow.
